I, the participant, acknowledge that I am voluntarily participating in activities provided by Atlantic Adventures, including but not limited to clear kayaking tours, guided excursions, kayak rentals, swimming activities, launching and landing activities, and all related water-based activities.

Inherent risks

I fully understand and acknowledge that participation in these activities involves inherent risks and dangers, including but not limited to:

• Drowning, injury or death
• Slipping or falling
• Collision with kayaks, rocks, vessels, or other participants
• Strong currents, tides, waves, and changing weather conditions
• Marine life encounters
• Equipment malfunction or failure
• Physical exertion and fatigue
• Loss, theft, or damage to personal belongings including cell phones, cameras, jewellery, and valuables

Release of liability

I hereby release and discharge Atlantic Adventures, its owners, employees, guides, contractors, affiliates, and representatives from any and all liability, claims, demands, damages, or causes of action arising from injury, death, loss, or damage sustained during participation in any activity, save for claims arising from gross negligence.

Assumption of risk

I understand that participation is entirely at my own risk and I voluntarily assume full responsibility for all risks associated with these activities.

Personal belongings

Atlantic Adventures shall not be liable for loss, theft, or water damage to cell phones, cameras, jewellery, or any other personal belongings.

Medical fitness

I confirm that I am physically and medically fit to participate and that I do not suffer from any condition that may place myself or others at risk.

Safety compliance

I agree to follow all safety instructions provided by Atlantic Adventures staff and understand that failure to comply may result in removal from the activity without refund.

Equipment responsibility

I accept responsibility for any equipment damaged through negligence or misuse during the activity.

Photography & media

I grant Atlantic Adventures permission to use photographs or videos taken during activities for marketing and promotional purposes unless otherwise requested in writing.

Participants under 18

A parent or legal guardian must accept this agreement on behalf of any participant under 18 years of age and confirms that the minor is fit to participate and will follow all safety instructions.

Electronic acceptance

I acknowledge that ticking the indemnity checkbox at checkout constitutes my electronic acceptance of this agreement and is legally binding and equivalent to a handwritten signature (Electronic Communications and Transactions Act 25 of 2002). My booking details (name, email and phone number), together with the date, time and version of this document at acceptance, are recorded against my booking as proof of acceptance.

By ticking the checkbox I confirm that I have read, understood, and voluntarily accepted all terms and conditions stated above.
